24Hr Access Terms and Conditions

All members wishing to gain access to the gym, outside of manned hours will be required to read, understand and agree to these terms and conditions. In addition, prior to gaining 24Hr access all members must complete a health and safety induction.

 

1. Waiver of liability

You acknowledge that by participating in exercise and activities with True Women’s Fitness and Well Being, you may be exposed to certain risks.

In consideration of my involvement in activity you agree to release & indemnify True Women’s Fitness and Well Being as follows,

  1. You participate in the exercises and activities at your sole risk and responsibility.
  2. You release, indemnify and hold harmless True Women’s Fitness and Well Being, including its directors, employees, contractor and tenants from and against all and any actions or claims which may be made by me or on my behalf by other parties for or in respect of or arising out of an injury, loss, damage or death caused to you or your property whether by negligence, breach of contract or in any way whatsoever.
  3. You also agree that in the event you become injured or your property is damaged, you will bring no claim, legal or otherwise, against True Women’s Fitness and Well Being in respect of that injury or damage.

 

 2. Induction

All members wishing to use the club during unmanned hours must attend a safety and wellness induction. Upon successful completion of the induction you will be issued with your access control card (door card).

 

3. Monitoring

True Women’s Fitness and Well-Being is monitored by cameras 24hr per day for your safety, the safety of the club and its members. Please be aware of your surroundings and exercise caution when working out during unmanned hours. Please be aware that video records will be kept for up to 30 days and may be viewed by management and/or emergency personal or police in the case of emergency or misdemeanour.

Your personal details will be held securely in accordance with the Privacy Act 1994.

 

4. Tail-Gating and Allowing Access to Non-members

When you use your access control card (door card) only one person (you) may enter at a time. Allowing another person, whether they are a member or not, to enter with you is strictly forbidden. Allowing another person to enter on your “card swipe” will result in $150 fine. In addition your gym membership will be suspended until the fine has been paid.

You will be notified and failure to pay your fine within 30 days of notification and/or failure to pay any other membership or program fees due will result in a debt collection agency being engaged to recover the costs at your expense.

Allowing another person, especially non-members into the gym poses a safety risk to you, other members, the person themselves and the club, and as such we will take all measures to enforce this rule.

 

5. Loaning Your Access Control Card (Door Card)

Loaning your door card to another person is strictly forbidden. Doing so will result in $150 fine. In addition your gym membership will be suspended until the fine has been paid.

You will be notified and failure to pay your fine within 30 days of notification and/or failure to pay any other membership or program fees due will result in a debt collection agency being engaged to recover the costs at your expense.

6. Panic Buttons

For your safety we have installed a fixed panic button in the gym. In addition we have provided 2 wireless panic buttons. You may take one wireless panic button while you work out at the club. Buttons must only be pushed in times of emergency. If you or another member need emergency attention (not being able to find your towel…is not an emergency) please press the button to call security. A security guard will attend when a panic button is pushed.

Pressing panic buttons by accident, as a ‘joke’ or due to malicious intent in times when no emergency is occurring will result in $150 fine plus any and all security call-out fees. In addition your gym membership will be suspended until the fine and call out fees have been paid.

You will be notified and failure to pay your fine and the security guard call out fee within 30 days of notification and/or failure to pay any other membership or program fees due will result in a debt collection agency being engaged to recover the costs at your expense

 

7. When To Use Panic Buttons

Situations Where Use of Panic Buttons is Acceptable

  • Severe accident or injury requiring medical attention to yourself or another member (please remain in the building until help arrives)
  • A fire (please leave the building, but remain on site until help arrives)
  • The presence of a malicious or threatening intruder inside the building (in addition please use your cell phone to call police if you believe you are being threatened)
  • The presence of a threatening person in the car park or nearby (please remain in the building until help arrives)

 

Situations Where Use of Panic Buttons is Not Acceptable

  • Any use of the button other than those described above
  • As a joke
  • Through malicious action intended to waste time or resources.

 

8. Restricted Areas

The reception, the offices, RPM room and the group fitness studio are all restricted areas during unmanned hours. These areas are alarmed and you will trigger the alarms by entering these areas.

Entering these areas during unmanned hours will result in $150 fine plus any and all security, ambulance or fire service call-out fees. In addition your gym membership will be suspended until the fine has been paid.

You will be notified and failure to pay your fine within 30 days of notification and/or failure to pay any other membership or program fees due will result in a debt collection agency being engaged to recover the costs at your expense.

 

9. Lighting and Access

At 10.30pm the lighting switches to sensor mode. If no motion is detected for 20 minutes the lights in certain areas will switch off. There are 3 zones – front of gym, rear of gym and change rooms. If the lights in one area are off simply walk into that area and they will turn back on. You may not access the main group fitness studio or the RPM studio outside manned hours.

 

10. Age Restriction

Members under 18 years may not use the after hours facilities

 

11. Outstanding Monies

If your membership account or any payments for challenges or fitness or nutrition programs are overdue you will not be able to gain access to the club. Your access will be restricted until all accounts are paid up to date.

 

12. Inappropriate Behaviour

It is forbidden to use inappropriate behaviour such as using loud, insulting, abusive, demeaning, insulting language, or harassing or bothering other members or staff. This is not an exclusive list and if you are found to be behaving inappropriately in any way at any time will result in $150 fine. In addition your gym membership will be suspended until the fine has been paid.

You will be notified and failure to pay your fine within 30 days of notification and/or failure to pay any other membership or program fees due will result in a debt collection agency being engaged to recover the costs at your expense.

 

13. Freezing of Membership

You may not use the club at any time while your membership is frozen. Please see reception for the terms and conditions for freezing memberships.

 

 14. Transferring your membership to another person

You may transfer the unexpired portion of your membership to another person. To transfer your membership to another person, please apply to the club accounts manager. All of the normal terms and conditions of membership and club entry will apply to the transferee. A transfer fee of $50 will apply.

Transferring a membership does not confer the right to 24Hr access. The person to whom you transfer must purchase their own access card and complete the 24Hr access induction.

 

15. Termination of Membership

Upon termination of your membership, your 24Hr access will also be terminated.

 

16. No Refunds Apply

Any payments for either the 24Hr swipe card or any other payments made in connection with your 24Hr access privileges are non-refundable.

 

17. Equipment

It is forbidden to unplug, remove, replace or otherwise tamper with any equipment in the club. This includes sound equipment, switches, electronic devices or any other club or building service.

Doing so will result in $150 fine, plus the cost of replacing the button if you “lose” the device by accident. In addition your gym membership will be suspended until the fine has been paid.

You will be notified and failure to pay your fine within 30 days of notification and/or failure to pay any other membership or program fees due will result in a debt collection agency being engaged to recover the costs at your expense.

 

18. Etiquette

Please replace weights and return any equipment to its rightful place when you have finished using them. In addition please wipe down any machines or benches that you have used.  There is no smoking, alcohol or drugs abuse allowed in the club.
